Probate
Will of Randolph Barnhouse
I, Randolph Barnhouse, of the County of Loudoun and the State of Virginia , being of sound disposing mind and memory considering the uncertainty of life and being desirous to settle my worldly affairs while I have strength and capacity do make this my last will and testament, hereby revoking all former wills by me heretofore made.
I bequeath unto my son, Nelson West Barnhouse, his heirs and assigns, my two horses, Daisy and Jr.
I bequeath unto my son, Edgar Jones Barnhouse, his heirs and assigns, my horse, Flash.
I hereby will and direct that my executor hereinafter named shall until the death of my beloved wife, Elizabeth Ann Barnhouse, have full control and use of all of my real and personal consisting of the farm of about two hundred acres (200) purchased by me of Charles F. Fadley and Orra M., his wife, whereon I now reside; all moneys, stocks, bonds, notes or other evidence of value; all of the household furniture and utensils, stock farming implements and growing of other crops to be worked, used and conducted by them as at present and heretofore, they to provide a comfortable and suitable home such as she has heretofore had as long as she may live.
To my wife, Elizabeth Ann Barnhouse and in addition, the said Elizabeth Ann Barnhouse shall have annually one third of all of the receipts and proceeds from said estates as long as she may live; to be handed over to her by my said executors; provided that in case my said wife, Elizabeth Ann Barnhouse, shall not accept of the provisions and legacies herein mentioned and made and shall, at any time prosecute my action in suit for I own, thirds, or any other part of my estates, real or personal other than I have heretofore devised and given her, then and in that case, the bequest shall and be void to all interests and purposes, anything to the contrary notwithstanding. I declare my will be that after the death of my said wife, Elizabeth Ann Barnhouse, my real estate heretofore mentioned shall be divided and I bequeath it as follows:
To my two sons, Nelson West Barnhouse and Edgar Jones Barnhouse, their heirs and assigns, all of that portion of said farm northwest of the road known as the Nolands Ferry and Leesburg Road and between said road and the lands of Mason’s Heirs, Penrose Jones and of the widow and heirs of Powell Harrison. It is my wish and desire that my said sons hold and retain this land without division, but if they cannot agree to this, then my executors, hereinafter named shall sell the same either at public or private sale as they may deem but, and shall make an equal division of the proceeds of said sale between my said sons, Nelson West Barnhouse and Edgar Jones Barnhouse.
To my daughter, Elizabeth Jane Chick, her heirs and assigns, eight (8) acres of land in addition to the three (3) acres set aside for her upon which the house built by her husband now stands, the whole to be in an irregular tract bounded on one side by the Nolands Ferry and Leesburg road aforesaid; on one side by the lands of the widow, and heirs of Powell Harrison; on one side by the branch running parallel with the boundary line between said land and the lands of the widow and heirs of Powell Harrison, heretofore mentioned.
To my son, John Randolph Barnhouse and my daughter, Margaret Ann Hunter, their heirs and assigns, all of the residue of said farm, to be divided into two equal parts, by a line parallel with the northeastern boundary line of the land here in before bequeathed to Elizabeth Jane Chick, the said John Randolph Barnhouse, to have the one half adjoining land at the side of the land here in before bequeathed to Elizabeth Jane Chick, and the said Maargaret Ann Hunter, to have the remaining one half. After the death of my wife, Elizabeth Ann Barnhouse, I will that an equal and satisfactory division of all of my personal estate be made between all of my children aforesaid and it is my desire that this division be made without a sale of any part of said personal estate. If this cannot be agreed upon, my executors here in after named, shall sell the same, either at public or private sale as in their judgment, they may deem best, and make an equeal portion to each of my children herein before named. I direct that all of my just debts and my funeral expenses shall by my executors here in after named, be paid out of my estate, as soon after my decease as shall by them be found convenient. I nominate and appoint my two sons, Nelson West Barnhouse and Edgar Jones Barnhouse to be the executors of this, my last will and testament and I direct that they be exempt from giving a surity or sureties upon their official bonds. In testimony whereof, I, the said Randolph Barnhouse, have set my hand to this, my will, in the County of Loudoun and State of Virginia, this ninth day of October, 1895. RANDOLPH BARNHOUSE
Signed by the testator in the presence of us, who in his presence and that of each other at the same time have hereunto subcribed our names as witnesses.
